Terms and conditions of sale

These terms and conditions of sale apply to every distance sale of a piece by Lutèce to a consumer, whether the sale is made on lutece-aer.com, via WhatsApp or by email.

1. The seller

LUTECEAER (trading as Lutèce), a French simplified joint-stock company (SAS) registered with the Paris Trade and Companies Register under number 131 026 338, with its registered office at 47 rue Vivienne, 75002 Paris, France.

Email: contact@luteceaer.com · Phone: +33 6 09 83 21 50. Further company details are given in the legal notice.

2. An independent reseller

Lutèce is an independent reseller of luxury pieces: it is neither affiliated with, nor authorised or sponsored by, the houses whose pieces it resells. The brands mentioned on the site belong to their owners and are used only to identify where the pieces come from.

3. The pieces

Each piece is unique. Its page on the site, or the written offer sent to you, states its main characteristics, its condition (new or pre-owned) and its price. The piece delivered matches that description.

Lutèce sells only authentic pieces. A piece proven not to be authentic does not conform to the contract: you are then covered by the legal guarantee of conformity (section 10), which, for a defect this serious, lets you end the sale and obtain a full refund on returning the piece.

4. Finding a piece

A search request, made through the site form, WhatsApp or email, is free and without obligation. If Lutèce finds the piece, it sends you a written offer (description, condition, price, delivery costs). The sale is made only if you accept that offer; it is then governed by these terms, including the right of withdrawal.

5. Prices

Prices are shown in euros, including all taxes. Delivery costs are added to the price and shown to you before you confirm the order. For delivery outside the European Union, import duties and taxes may be charged to the recipient by the country of delivery; they are payable by the recipient unless stated otherwise before the order.

6. Ordering

On the site, you add the piece to your cart and are then taken to the secure checkout of our provider Shopify. There you check the order details and total price, and can correct your information before confirming. The sale is made when you confirm the order and your payment is accepted; a confirmation is then sent to you by email.

As each piece exists only once, it goes to the first accepted payment. If a piece is no longer available after your payment, Lutèce informs you and refunds all sums paid without delay.

These terms remain available on this page at all times. For an order of €120 or more, Lutèce keeps the record of the contract for ten years and gives you access to it on request.

7. Payment

The price is payable when you order, by one of the methods offered at checkout. Your payment details are processed by the payment provider; Lutèce has no access to them. For a sale made via WhatsApp or by email, payment terms are set out in the written offer.

8. Delivery

Lutèce delivers to the countries offered at checkout, by carrier and with tracking. The delivery time is shown to you before you confirm the order; failing that, the piece is delivered no later than thirty days after the sale is made.

If the piece is not delivered on time, you may ask Lutèce in writing to deliver it within a reasonable additional period; if it is still not delivered within that period, you may end the sale and be refunded.

The piece travels at Lutèce's risk until you, or a person you have designated, take physical possession of it.

9. Right of withdrawal

You have fourteen days to withdraw from the sale without giving any reason. This period runs from the day you, or a third party other than the carrier designated by you, take physical possession of the piece. This right also applies to a piece found for you following a search request.

To exercise it, inform Lutèce of your decision before this period ends, by an unequivocal statement sent by email to contact@luteceaer.com or by post to 47 rue Vivienne, 75002 Paris, France. You may use the model form below, but it is not obligatory. Lutèce acknowledges receipt of your withdrawal without delay. You can also withdraw directly on the website, using the “Withdraw from contract here” link at the bottom of every page.

You send the piece back to Lutèce, at the address given in the acknowledgement, without undue delay and no later than fourteen days after informing it of your decision. You bear the direct cost of returning the piece. Given the value of the pieces, we advise a tracked shipment insured for their price.

Lutèce refunds all sums paid, including delivery costs (up to the cost of the least expensive standard delivery it offers), no later than fourteen days after being informed of your decision. It may withhold the refund until it has received the piece back or you have supplied proof of having sent it, whichever is earlier. The refund is made using the payment method used for the order, at no cost to you, unless you expressly agree otherwise.

You are liable only for any loss in value of the piece resulting from handling beyond what is necessary to establish its nature, characteristics and functioning. Keep the tags, packaging, certificates and accessories delivered with the piece: they are part of it.

10. Legal guarantees

Lutèce is liable for any lack of conformity of the piece (articles L217-1 et seq. of the French Consumer Code) and for its hidden defects (articles 1641 to 1649 of the French Civil Code). For a pre-owned piece, the presumption that a defect existed at delivery lasts twelve months (article L217-7 of the French Consumer Code); the guarantee still lasts two years.

Legal guarantees (statement required by article D211-2 of the French Consumer Code, translated)

The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer need only establish that the lack of conformity exists, not when it appeared.

Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or digital service throughout the planned period of supply. During this period, the consumer need only establish that the lack of conformity affecting the digital content or digital service exists, not when it appeared.

The legal guarantee of conformity obliges the trader, where applicable, to supply all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and obtain a full refund on returning the goods, if:

  • 1° the trader refuses to repair or replace the goods;
  • 2° the repair or replacement takes place after thirty days;
  • 3° the repair or replacement causes the consumer major inconvenience, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
  • 4° the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that an immediate price reduction or termination is justified. The consumer is then not required to ask first for repair or replacement.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee until the goods are delivered back in working order.

The rights set out above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be raised to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund on returning the goods.

To invoke a guarantee, write to contact@luteceaer.com describing the defect. Lutèce offers no commercial guarantee beyond these legal guarantees; any manufacturer's warranty remains that of the house concerned, under its own terms.

11. Customer service and complaints

For any question or complaint: contact@luteceaer.com, +33 6 09 83 21 50, or by post to 47 rue Vivienne, 75002 Paris, France.

12. Consumer mediation

In the event of a dispute, first send Lutèce a written complaint. If this does not resolve it, you may refer the matter free of charge to the consumer mediator Lutèce belongs to, within one year of your written complaint (articles L612-1 et seq. of the French Consumer Code).

13. Governing law

These terms are governed by French law. If you live in another country, you keep the protection given to you by the mandatory provisions of the law of your country of residence. Failing an amicable settlement, you may bring proceedings before the court of the place where you lived when the sale was made or where the damaging event occurred, or before any other competent court.

14. Personal data

The data collected to process your order is protected as explained in our privacy policy.
